1. Introduction

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name [www.nsoindia.com] [www.nsoindia.com] ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform")

The Platform is owned by NSO Services Private Limited a company incorporated under the Companies Act, 2013 (18 of 2013) and rule 18 of the Companies (Incorporated) Rules, 2014 with its registered office at NEAR NEW COURT, GF-1, Sumitra Heights, KACHERY ROAD, UDITNAGAR, Rourkela, Sundergarh, Odisha, India, 769012 (hereinafter referred to as "NSO Services").

2. Membership Eligibility

Transaction on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents, etc. are not eligible to use the Platform. If you are a minor i.e. under the age of 18 years, you may use the Platform or access content on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian.

As a minor, if you wish to transact on the Platform, such transactions on the Platform may be made by your legal guardian or parents. NSO Services reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if it is brought to NSO Services' notice or if it is discovered that You are under the age of 18 years and transacting on the Platform.

3. Your Account and Registration Obligations

If You use the Platform, you shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform and refuse to provide You with access to the Platform.

Your mobile phone number and/or e-mail address are treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address are up to date on the Platform at all times.

4. Platform for Transaction and Communication

The Platform is a platform that Users utilize to meet and interact with one another for their transactions. NSO Services is not and cannot be a party to or control in any manner any transaction between the Platform's Users.

Key Points:

• All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone.
• NSO Services does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.
• NSO Services does not make any representation or warranty as to specifics of the products or services proposed to be sold or offered to be sold or purchased on the Platform.
• NSO Services is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers.

5. Use of the Platform

You agree, undertake and confirm that Your use of the Platform shall be strictly governed by the following binding principles:

Prohibited Activities:

• You shall not host, display, upload, modify, publish, transmit, update or share any information which belongs to another person and to which You do not have any right to.
• You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic devices to access, acquire, copy or monitor any portion of the Platform.
• You shall not attempt to gain unauthorized access to any portion or feature of the Platform.
• You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us.

6. Charges

Membership on the Platform is free for buyers. NSO Services does not charge any fee for browsing and buying on the Platform. NSO Services reserves the right to change its Fee Policy from time to time.

7. Payment

While availing any of the payment method/s available on the Platform, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

• Lack of authorization for any transaction/s
• Exceeding the preset limit mutually agreed by You and between "Bank/s"
• Any payment issues arising out of the transaction
• Decline of transaction for any other reason/s

8. Disclaimer of Warranties and Liability

This Platform, all the materials and products (including but not limited to software) and services, included on or otherwise made available to You through this site are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing.

NSO Services will not be liable to You in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Platform.

9. Indemnity

You shall indemnify and hold harmless NSO Services, its owner, licensee, affiliates, subsidiaries, group companies (as applicable), and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, Privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

10. Applicable Law

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bangalore.
